We, This Art Foundation (Overtoom 40, 1054 HK, Amsterdam, registered with the Chamber of Commerce under number 34227573), hereby inform you about our privacy policy. This policy applies to the entire The Pool platform, the thepool.art and springboardartfair.com websites, and all The Pool’s sub-domains.

The Pool’s platform focuses on showcasing the professional practice of visual artists, exhibitions and artworks placed by participating artists and art professionals.

By using our platform, for instance, by visiting and viewing the platform, creating an account, contacting members or using the community, we will process the personal data you enter according to this privacy policy. We advise you to read this policy carefully.

The Pool is committed to the responsible processing of personal data. Your personal data is processed and protected in accordance with General Data Protection Regulation (GDPR). Pursuant to the GDPR, The Pool is responsible for the correct application of this Act.

 

Using The Pool

Type of personal data

When you use The Pool, we automatically record the following data:

– details of the equipment used including your IP address, operating system, resolution and browser;

– the time you visit the platform, the duration of the visit and the pages you view;

– location data and language settings originating from your IP address or devices.

We use cookies to improve your user experience and to register your usage. In our Cookie Terms and Conditions, we explain how we do this and what we use the data for.

 

Purposes for use

We use the user data that we record for the following purposes:

 

  1. To be able to offer a personalised website

The Pool gives you the opportunity to follow artists, save favourite works of art and contact artists. In order to improve this personalised experience, we collect data to build up a personal profile. We collect data in order to build up a personal profile and use it to personalise, optimise and improve your user experience.

 

2.  To improve The Pool platform

We use your browsing and viewing habits, in combination with your profile, to conduct research so that we can improve our platform and gain insights into trends and interests. Your data is anonymised in this research and cannot be traced back to individual visitors.

 

3. To combat improper use

IP addresses are used to detect and combat unauthorised use of The Pool. An example of unlawful use is ‘spidering’ / ‘crawling’ (searching) The Pool, which inconveniences other users.

 

Using personal data in your The Pool account

Type of personal data

Some of the services on the platform require you to open a personal account. For this we ask you for your name, personal details and email address. You can also enter your telephone number on a voluntarily basis.

 

Purposes for use

We use your data for the following purposes:

1. To personalise your use

The Pool uses your data to analyse personal interests. We use this data to create a personal profile. We then use this profile to offer you a personalised user experience and to gear the platform to suit your interests.

2. Account security

Your login details (email address and password) are used to secure your account. You can change your personal data in your personal environment.

 

3. Email marketing

If you register for an account, you will automatically be sent a newsletter. This newsletter contains editorials, current news items and a calendar of events by and for members. Part of this newsletter may be personalised; if you follow artists, priority will be given to news about them.

 

4. Services

The data in your account is used to provide services on The Pool. These services include:

 

– informing you by email of new members or updates of artists you follow;

– saving artists’ profiles;

– taking care of communications between you and other members;

– using the community tools, like a forum or feed

– sharing artists and professionals on social media.

 

5. Research

We use the data from your account to improve our products and services. We anonymise your personal data, if possible, for this research.

 

6. Contact

We use the data that you provide to contact you, if necessary. We may do so to answer questions and/or handle complaints.

 

Disclosing your personal data to third parties

The Pool does not disclose personal data to third parties, unless it is obliged to do so on the grounds of a statutory provision or a ruling handed down by the court or supervisory authority, or unless it is necessary in the interests of preventing, detecting or prosecuting criminal offences (such as fraud, deception or embezzlement) or unless you have given your permission.

We may engage other service providers to process your personal data. These service providers work on the instructions of The Pool and they process your data in accordance with these privacy terms and conditions as well as according to the laws and regulations applicable in the Netherlands.

 

Protecting your personal data

We protect your personal data against loss, unauthorised use, unlawful processing on the part of third parties and access to your data by unauthorised persons.

 

To protect your data, we use data encryption, passwords and password conditions, and physical access protection, among other things. Your data is only stored in data centres in the Netherlands, which are certified for: ISO 27001, ISO 9001, PCI-DSS, NEN 7510 and ISAE 3402 Type I.

 

Control of your personal data and the right to object

You can see what personal data you have entered in your personal environment. You can also amend and delete your data in this environment. By contacting our help desk (info@thepool.art), you can access, change or have all your data erased free of charge. You are always entitled to object to the use of your personal data.

We do not keep your data for longer than is legally permitted and automatically delete your data if it no longer serves the above purposes.

 

Amendments

The Pool reserves the right to revise this privacy policy. If we make any changes to this policy, we will notify account users by email. If you don’t have an account, we advise you to review this privacy policy regularly.
