Terms

  1. General

The conditions under which participation in Springboard Art Fair is possible are laid down in these conditions of participation as drawn up by This Art Foundation

  1. Definitions

2.1 Organizers: Springboard Art Fair is organized by This Art Foundation registered with the Chamber of Commerce under KVK number 34227573, based in Amsterdam, Overtoom 40,1054 HK.

2.2 Fair: Springboard Art Fair is an arts platform for contemporary art and related disciplines. The Fair will take place in the WerkspoorKathedraal, Tractieweg 41, 3534 AP Utrecht during June 8 – 11, 2023.

2.3 Enroller: any natural person or legal entity who has registered as a participant for Springboard Art Fair 2023 by means of a binding registration form, regardless of whether this registration has been accepted and confirmed by the Organizers.

2.4 Application Form: the form completed and signed by Entrant on the website www.thepool.art.

2.5 Participant: any Entrant who has received confirmed participation in Springboard Art Fair 2023 (allocation letter) sent by the Organizers to the Entrant by email.

2.6 Participation Agreement: agreement between Organizers and Participant, created by the concurrence of will, evidenced by the receipt by Organizers of the Entry Form completed and signed by the Entrant and the subsequent confirmed participation in Springboard Art Fair 2023 (Allocation Letter) sent by Organizers to the Entrant by email.

  1. Participation

3.1 Participation in Springboard Art Fair 2023 is only possible upon invitation by the Organizer and after review of the Entrant’s application leading to the formation of a participation agreement.

3.2 The Entrant must in any case meet the following professional criteria:

– Has graduated from a recognized Dutch art academy or postgraduate institution during the period September 1, 2018 and December 31, 2021. Or has Dutch nationality and graduated from a recognized foreign art academy or post-academic institution during the period September 1, 2018 and December 31, 2021

– Is a professional artist, designer or designer.

– Shows work no older than 5 years.

  1. Application

4.1 Signing up to participate in Springboard Art Fair is done by creating a profile on The Pool (www.thepool.art).

4.2 To apply for booth space and submit the exhibition program for the Fair, enclosing any documentation materials, you must complete an application form and profile at www.thepool.art.

4.3 The application form does not guarantee participation.

4.4 Allocation of booth space will take place as described below.

4.5 The closing date for returning the Registration Form is Friday, March 31.

4.6 The profile must remain unchanged for at least 4 weeks after this date at www.thepool.art.

  1. Selection Committee

5.1 Applications will be reviewed by an independent selection committee consisting of artists, gallery owners and curators. Organizers and selection committee will review the applications and in some cases may recommend replacing or omitting one or more works from the proposed exhibition program.

  1. Registration and booth space

6.1 The Subscriber declares to accept all consequences of the registration resulting from the signing of the Registration Form.

6.2 No rights can be derived from the registration by means of the Application Form. The Organizer reserves the right not to offer the Entrant stand space at the Fair.

6.3 When determining stand space the Organizer will take into account as much as possible the wishes of the Participant.

6.4 The Participant’s determination of stand space is binding on the Participant both in terms of type and location.

Registration is binding. Once the Registration Form has been accepted, the Participant can no longer cancel.

8.1 The Organizer reserves the right to cancel the Art Fair at any time as a result of a (local or international) health crisis (such as a pandemic) that has led to increased requirements published, announced or otherwise reasonably known by the Dutch Central Government that do not reasonably allow the Art Fair to proceed.

  1. Fees, coaching and stand construction.

9.1 Participation in Springboard Art Fair is free of charge to Participant.

9.2 Participant receives an expense allowance of € 200,- excluding VAT (if VAT is applicable).

9.3 Participant will be assigned an art professional as coach. The coach has a non-committal advisory role. In connection with the limited possible time investment of the coach, the participant must deal reasonably with the expected commitment of the coach. As an indication, the coach has a total of 25 hours to devote to the coaching of 5 artists.

9.4 Participant needs to make a stand layout in consultation with coach and 4 fellow artists and coach. Frameworks for this will be provided by the fair in cooperation with Tom Postma Design.

  1. Location, time and opening hours

10.1 The Fair will take place from 8 – 11 June 2023 in the Werkspoorkathedraal, Tractieweg 41, 3534 AP Utrecht.

10.2 On Thursday June 8 a press preview will be organized from 15.00 – 16.00 followed by an evening opening for invited guests.

Thursday, June 8 from 16:00 to 21:00 (“Preview”)

Friday, June 9 from 11:00 to 19:00.

Saturday, June 10 from 11:00 to 19:00.

Sunday, June 11 from 11:00 to 18:00.

10.3 Organizers reserve the right to unilaterally change the opening hours as mentioned under 10.1 and 10.2.

  1. Entry fees

11.1 The entrance fee (subject to change) for visitors is at least €7.50 plus service charge per person, per visit excluding VAT.

11.2 Organizers reserve the right to unilaterally change the admission prices as mentioned under 11.1.

  1. Participant badges

Participant badges are exclusively for the Participant and stand personnel. It is not permitted to provide Participant badges to third parties nor to resell them to third parties without the Organizer’s permission.

  1. Relation cards

Each Participant will be sent by the Organizers at least 10 invitations to the Preview, opening or regular exhibition days (“Relation Card” or “Relation Cards”).

These Relationship Cards entitle 1 person to access to a pre-booked time slot of The Fair.

  1. Description uniform stand construction

The walls a 275 cm high; name indication; and electricity consumption. No changes such as different height, color or upholstery may be made to the uniform stand construction without the permission of the Organizers. The walls must be left in good condition. No texts or expressions other than those belonging to the exhibited artworks on the walls are allowed. Participant must comply with all requirements and regulations of the Werkspoorkathedraal.

  1. Stand

– Place and dispose of empty packaging outside the stand space.

– Stock the stand during the opening hours of Werkspoorkathedraal from 10.15 to 11.00 daily.

  1. Publicity

16.1 The Organizers will conduct a thorough publicity campaign for the Fair.

16.2 Participant will invite his or her network to the Fair.

16.3 The Fair may use image of participant for promotional purpose and visa versa.

  1. Works to be exhibited

17.1 Participants of the Fair are expected to man and/or have their own presentation manned for the entire duration and during the opening hours of the Fair.

17.2 Participant is responsible for the transport, arrival and receipt of his/her or for his/her participation’s artworks. The organizers will not take delivery of the Participant’s artworks nor is it in any way liable for the artworks.

17.3 Participant is responsible for sale and insurance of his/her artwork. The Fair has no role in this. Therefore, no remittance is requested in case of any sale.

  1. Preview

On June 8 from 16.00-21.00 there will be a private preview. The organizers invite directors and curators of Dutch museums for modern art as well as institutional collectors (companies, institutions, etc.). Participant will receive 10 relationship cards to distribute to his/her network.

19. Liability

19.1 The Organizer is not liable for damage suffered by the Participant due to shortcomings on the part of the Organizer in the execution of the commitments entered into between Participant and Organizer, unless the damage is caused by gross fault or intent on the part of the Organizer.

19.2 The Organizer only accepts liability of the Organizer for the damage suffered by Participant, provided that this attributable failure, is covered by their liability insurance.

19.3 Artworks are located in the Werkspoorkathedraal or on associated grounds at the expense and risk of the Participant. The Organizer is not liable for damage from whatever cause to works of art or persons caused by or in connection with participating in the exhibition.

19.4 Nor are the Organizer liable for damage to third parties caused by the use of the stand by the Participant or his staff.

19.5 The Participant indemnifies the Organizer against all claims that others could assert against the Organizer in connection with his actions or omissions.

  1. Disputes/applicable law

All disputes arising from or relating to participation in the Fair will be submitted to the competent court in Amsterdam. Dutch law is applicable here.

  1. Timetable

Set-up of stands:  

Wednesday, June 7 from 08:00 till 20:00

Thursday, June 8 from 08:00 till 15:00 hours

Exhibition days:

Thursday, June 8 from 16:00 till 21:00  (Preview)

Friday, June 9 from 11:00 to 19:00.

Saturday, June 10 from 11:00 to 19:00.

Sunday, June 11 from 11:00 to 18:00.

Dismantling:

Sunday June 11 from 18:30 to 22:00 hours

21.1 Organizers reserve the right to unilaterally change the opening times as mentioned under 21.1.
